“Law chief in supreme court warning: The lord president of Scotland’s highest civil court yesterday warned that the creation of a UK supreme court would be “retrograde and damaging” to the separate identity of Scots law. He demanded a limit on its powers [. . .]
“If the proposal for a UK supreme court is to proceed, it is vital that the binding effect of its decisions in civil appeals should be limited to the jurisdiction from which the appeal has come from, and that there are sufficient safeguards built in to the powers of the proposed court to perserve the separate identity of the civil and criminal law of Scotland. . .” Herald

“Don’t underestimate the jury: It is highly unlikely that one would find among Scottish judges, or among practitioners in the criminal courts, an unequivocally positive assertion that trial by jury is without flaw. Leaving aside the deficiencies inherent in any process that depends on human judgment, the seclusion of the jury and the prohibition of investigation of its deliberations give the procedure a mystery that some commentators contend undermines the fairness of the procedure as a whole.
